High Court announcement, AGM motions and nominations, AGM Club delegates, ABT selection shoot alteration and General Secretary information (up-dated)

Court Ruling:

As a result of misinformation being circulated by some parties in recent days, the ICPSA National Executive would like to notify all members of the following:  "On Monday 9th June 2008, in the case of Hannifin & Others v. Irish Clay Pigeon Shooting Association, the High Court made an award of costs in favour of the plaintiffs, and against the Association, measured by the Court at €5,000 plus VAT at 21%.  There is a stay on the Order for 21 days, and the Association shall take advices in relation to the Order in the coming days and consider its position in due course.  It should be noted that the said Order does not impact on the recent disciplinary proceedings against, and subsequent suspension from membership of, the Naul Clay Pigeon Shooting Club in any way.  The said suspension remains in force until such time as the Naul Clay Pigeon Shooting Club complies with the terms of the findings of the disciplinary committee".

The National Executive would like to remind ICPSA members that all money expended by and on behalf of the Association is their money generated through their affiliation fees and their shoot levies.

 

75th ICPSA AGM-Motions.

Motion 1: 

The ICPSA National Executive proposes that Article 31 will be amended to read:

The Executive Committee shall, subject to the last preceding article consist of the following persons elected at the AGM in accordance with Article 8;

1.  The Chairman of the Association.

2.  The Honorary Secretary.

3.  The Honorary Treasurer.

4.  Representatives of the Provinces not exceeding eight in total and nominated at the AGM as follows:                                        

Two representatives nominated by the recognised provincial association for Leinster.                                               

Two representatives nominated by the recognised provincial association for Connaught.                                               

Two representatives nominated by the recognised provincial association for Ulster.                                               

Two representatives nominated by the recognised provincial association for Munster.            

In all cases the representatives must be members of the Association.

Motion 2:

The Connaught Clay Pigeon Shooting Association proposes that Article 31 will be amended to include:

The ICPSA shall have two Statistical Officers who shall not be members of the National Executive.

One Officer shall be responsible for the disciplines of DTL and ABT inclusive.

The second Officer shall be responsible for the ISSF disciplines, Sporting, FITASC disciplines and National Skeet.

These Officers shall be elected annually at the ICPSA AGM and may be nominated in accordance with the provisions laid down for Executive Committee members.

Nominations must specify the Statistical Officer position applied for.

Motion 3:

The ICPSA National Executive proposes that Article 34 will be amended to read:           

(a)        The business of the Association shall be managed by the Executive Committee who may pay all expenses incurred in promoting and registering the Association, and may exercise all such powers of the Association as are not by the Acts or by these articles required to be exercised by the Association in general meeting, subject nevertheless to the provisions of the Acts and of these articles and to such directions, being not inconsistent with the aforesaid provisions, as may be given by the Association in general meeting provide that no such provision shall invalidate any prior act of the Executive Committee which would have been valid if that direction had not been given.

(b)        A member or connected party, who is involved either financially or otherwise with a commercial club or grounds, shall not permit his name to be put forward for election to the Executive Committee.  For the purpose of this Article, a connected party shall be as defined in the Companies Act, 1963 to 1999.

(c)        For the purpose of this Article a commercial club or grounds shall be one in which all members do not have equal rights, or are not entitled to an equal share in any surplus generated, or whose members, on disbandment, or liquidation are not entitled to an equal share of any excess generated.

(d)        In the event of a dispute as to whether or not a club or grounds is commercial, the onus of proof shall rest with the member.

Motion 4:

The Leinster Clay Pigeon Shooting Association proposes that the ICPSA will make the reduced membership fee for juniors available to any person in full time education up to the age of 23.  A student card will not be accepted as proof of full time education.  A confirmation of attendance from the educational institution must be furnished for a member to avail of the reduced membership fee.

Motion 5:

The Leinster Clay Pigeon Shooting Association proposes that the ICPSA will introduce a family membership scheme.  An annual membership fee of €300 will be charged for families consisting of 2 parents and any children under the age of 18.  To qualify, all family members must be normally resident at the same address.  The €300 fee may be reviewed by the National Executive of the ICPSA and increased in line with other future fee increases.

Motion 6:

Balheary Gun Club proposes that with effect from 1st January 2009 that all ICPSA members who participate as part of an Ireland Team at any event may not represent any other country at any event at which an Ireland Team can normally participate.

Honorary Treasurer: Enda Clerkin- proposed by the ICPSA National Executive.


Statistical Officers: John Delaney and
Robert Cavanagh-proposed by the ICPSA National Executive.


Connaught Delegates: Edward Coleman and Pat Loughnane.

Leinster Delegates: Cian Merne and Sean O’Neill.

Ulster Delegate: Glenn Ross.

Munster Delegates: Yet to be nominated.

 

AGM Club Delegates:

In accordance with Article 29(a) of the ICPSA Articles of Association and as repeatedly advised to all clubs, the notification deadline for the nomination of club delegates has now passed and any nominations received from here on in will have to be disregarded.

 

Ireland ABT Team:

In the interest of equity, it has been decided on the advice of the ABT Task Group that any prospective member of the 2008 Ireland ABT Team who is involved in the World DTL Team qualifiers at Esker Shooting Grounds on 5th-6th July next may nominate the ABT shoot at Esker SG on 3rd August as their ABT compulsory shoot in lieu of the scheduled ABT selection shoot on 6th July. 

Any member who wishes to avail of this option must notify the General Secretary in writing on or before Friday 4th July next.

 

General Secretary Notice:

The General Secretary will be unavailable from Wednesday 11th June until Tuesday 17th June.  Consequently there will be no updated paid members list until 17th June next.
